- Liability for Stolen Goods (6 CPD points – Stream B – FTA080)
The theft of goods can occur from even the best run warehouse. The Customs Act provides that when such goods go missing a person entrusted with the possession, custody or control of the goods is liable for the duty that would have been payable on the stolen goods. The Government has always exercised this power against the corporate warehouse licence holder. However, in a dramatic development for the industry, the High Court has ruled that demands can be properly made against employees of the licence holder. This means that if you are an employee that has to day to day control over a warehouse, you are personally liable if goods are stolen from the warehouse. This will be the case even when you had no involvement in the theft.
